1. Service Description

NicheStats™ (“the Service”) is a YouTube analytics platform operated by TAP Commerce. The Service provides analytics and insights based on publicly available YouTube data via the YouTube Data API. We are not affiliated with, endorsed by, or partnered with YouTube or Google.

Certain features of the Service may include AI-generated insights, summaries, or suggestions. AI-generated content is provided for informational purposes only and may contain inaccuracies or omissions.

2. Accounts & Access

• Login is via Google OAuth.
• Guest and Free users may access limited data.
• PRO users (paid) access all niches and analytics.
• One account = one user. Sharing, resale, scraping, or redistribution of data is prohibited.
• Automated access, bulk extraction, or attempts to bypass technical or usage limits are prohibited.
• We may apply technical limits, rate limits, or access restrictions to ensure fair usage and system stability.
• We may suspend or terminate accounts that violate these Terms.

3. Subscriptions & Payments

• PRO subscriptions are billed via Stripe. Access to the Service begins immediately after successful payment.
• Subscriptions renew automatically each billing period unless you cancel via your Stripe customer portal (or in-app billing link).
• You can cancel at any time. Cancellation takes effect at the end of the current billing period; no refunds or credits are provided for partial periods.
• No refunds. Once access begins, payments are non-refundable and non-prorated, except where required by applicable law.
• EU/EEA withdrawal waiver. By subscribing, you expressly request immediate access to the digital service and acknowledge that your statutory 14-day right of withdrawal expires once the service has begun.
• Prices may change; reasonable notice will be provided before changes take effect.
• Coupons & Promotions. Promotional coupon codes may be offered at our discretion. Unless explicitly stated otherwise, each coupon code may be redeemed only once per customer account and may not be combined with other discounts, promotions, or offers. Coupons have no cash value, are non-transferable, and may be modified, suspended, or revoked at any time.
• Affiliate Programs & Referral Coupons. We may allow selected partners or affiliates to promote the Service using unique referral or coupon codes. Any commission or compensation related to such promotions is governed exclusively by a separate written agreement between NicheStats and the respective affiliate. Commissions, if agreed, are typically calculated based on the number of valid and paid coupon redemptions or resulting subscriptions. Unless expressly agreed otherwise in writing, no commission is owed.
• Abuse, manipulation, self-referrals, or attempts to artificially inflate coupon usage or affiliate metrics may result in immediate disqualification from the affiliate program and forfeiture of any unpaid commissions.

4. Data & Privacy

We collect your Google account details (name, email, avatar), subscription status, and usage logs. Payment details are processed by Stripe; we do not store card information. Data is stored securely in our databases.

6. Disclaimers & Liability

• The Service is provided “as is” without warranty of any kind.
• We do not guarantee accuracy, completeness, or uninterrupted availability of the Service.
• The Service may be unavailable due to maintenance, technical issues, third-party service outages, API limits, or force majeure.
• We are not liable for business, financial, or strategic decisions made based on information provided by the Service.
• Liability is limited to the maximum extent permitted by applicable law.

7. Intellectual Property

All rights in the Service, including its design, code, content, datasets, and branding, belong to us. You may use analytics results for your own internal or commercial purposes, but redistribution, resale, copying, or replication of the platform or its data is prohibited.

8. Changes

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in misuse of the Service. Upon termination, your right to use the Service will cease immediately.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Exclusive jurisdiction shall be the courts of Stuttgart, Germany, unless mandatory consumer protection laws provide otherwise.

12. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not be considered a waiver of those rights.
